Divorced, both sellers have moved out in last 3 months; would like to try HAFA but not a deal breaker; one lien only INDY and only one spouse is on the loan; hardship legit; 1) do they HAVE to go thru HAMP first? 2) Can we go straight to HAFA applicatoin before contract? 3) haven't accepted tenant yet until we know if she can rent then be purchaser IF DISCLOSED; 4) payments will be kept current by rent DISCLOSED and seller making up the difference - adamant about staying current; 5) will Indy even look at you without being late? They LOVE that PEC and change it all the time! It is arm's length such that house was listed and potential buyer is only a potential renter because of MLS ... not a pre-existing relationship - but once they rent, a condition for putting in contract - are we no longer arm's length? **BTW** potential buyer/tenant is also a realtor - told her she would have to receive $0 in commission - any way I can make this work, keep it ABOVE board and legal/legit ... this arms length thing can sometimes be crazy... THANKS ALL ... p.s tenant would rent only month to month but knows IF short sale does not get approved for whatever reason, she has to vacate at foreclosure, I guess ... ? month to month lease only
