I have been running in circles with Nation Star Mortgage since November - they declined my client on HAFA because they were not occupying the property.  I explained over and over again they had relocated out of State for employment.  For some reason it didn't register with them.  After many phone calls, emails, losing a contract, submitting a back up offer and then getting an email through Equator that the Servicer would not approve a short sale on this property - period-  - after they told me last week they would on the contract we lost if the Seller/Borrower signed a $5000 note, and all were willing to give up on HAFA just to be finished with this, we were all beat up, - and thank goodness had a back up offer come come in the day before .... and then my Client received trustee sale notice today - I escalated the file to HAMP admin.  Honestly, I am a veteran in the real estate industry, and so perplexed, disappointed, and distressed at the lack of professionalism and pure common business sense - I cannot even express the frustration and betrayal I feel.  I keep trudging along, after-all this is my chosen career, and my goal is to help those with hardship to avoid foreclosure.  Any experience with this type of situation with any of you?

As to your question if any of us has experience with this type of situation.....LOL....oh yes!!  I see that this is NationStar but it fits a BoA ss very well.  Before you throw in the towel on HAFA, please make sure your borrower/seller will receive a full release of the debt.  If not, CYA, make sure your client signs a disclosure.

Thank you for your supportive words.  That's why i submitted to HMP admin - have actually had pretty good luck with BofA - this team at Nat.Star has been driving me crazy.  I am trying to relax and do what I can to protect my Client - it's tough out there.
