First Horizon re: commissions

I have a First Horizon 2nd I will be dealing with. Contacted them for their SS package, in it it states that the brokerage commission is not to be more than 5%! I list at 6%. Has anyone challenged this?

Yes, and they let it foreclose rather than pay 6% and got nothing.
