Hello, I am going through my first AS-IS, short sale transaction (as a Buyer's Agent) and would like to know who is responsible for turning on water services at property?  Property is vacant.  The Lender has winterized the plumbing supply in the house, yet, has allowed the Owner (non-occupant)  to keep electricity on.  Is it the Purchaser's, Seller's or Lender's duty to hire a plumbing company to turn on water for inspection purposes?

Please advise.

  • I ALWAYS include in the contract that if the utilities need to be turned on, it is the buyers responsibility, otherwise it is the sellers responsibility

  • It is actually up to the seller whether they turn on utilities or not.  If the seller will not do it, you have to ask their permission for your buyer to inspect and turn on. 

  • The lender will not pay for this so it need to be the buyer/seller or agents. I have running accounts with the utility companies so I can connect service with a phone call.

  • It all depends on how the contract was negotiated. Read the inspection clause.
