In your experience, which lenders have you seen allow attorney fees on the HUD?  I'd love everyone to contribute if you know for sure.

 

So far these are the lenders I've seen allot payments to attorneys off the HUD

No special order:

1) Indy Mac

2) Carrington

3) BOA - If it's an attorney state

4) Wells

5) Chase

6) GMAC

7) AHMSI

...I know there are more, but I need to go through my stuff.

  • All of them.  It's some investors who do not allow.  I've had issues with Freddie as of late, but there is no actual guideline that prevents attorneys being paid.  What I have seen is either the attorney gets cut to $1,000, or they allow either attorney fee or title fee, but not both.

    Illinois is an attorney state, but that will not stop them, because as in other states, a title company attorney can prepare the deed for $50

    I get my attorneys paid 99% of the time.

  • Smitty, do you mean attorney fees for negotiating the short sale or attorney fees for closing the short sale?

    • Great question.  I should have clarified.  Seller representation was what I was looking for.

  • I am in an attorney state, seller cannot close without one.  I have never seen an attorney fee rejected.  That being said, they are conditioned lower all the time, much like commissions are, or I should say much like commissions used to be.
