Anyone got a higher up contact at FHA/HUD? I have a Bank of America short sale that's been going for months and we got one extension on it because we found an unknown 2nd that had to be addressed. We had until 11/27 to close and the buyer's lender couldn't meet that date. Went back and asked BOA for another extension and they are refusing and said we had plenty of time even though it wasn't our fault the buyer's lender was slow. We only need a few more days and they are telling us we'll have to start all over which puts us to 2013 and tax ramifications. I'm about to go over their heads to the investor, who I'm sure would like their money THIS year... help if you can! Love to have an email or phone number for a higher up at HUD/FHA!

They will need their FHA case number. It will be on the HUD90045 (ATP). the ATP dictates when the transaction needs to close by. If you are beyond the timelines outlined in the ATP then you will need a variance from HUD.

Is the ATP still valid?

Except that on the last two B of A FHA SCRA's I have received (both within the last 14 days), they did specify closing dates.
Yes, that date usually is the date on the Purchase Agreement and/or the Preliminary HUD-1. Revise both if an extension is needed.
I would escalate here first:
