We are in negotiations with BAC on a house that is schedule to sell this Thursday. The selling agent said he spoke with BAC last Friday (they are considering our counter offer) and they planned to postpone the trustee sale but I've checked the LPS listings and it shows it hasn't been postponed yet. Can they do it right up to the say? Getting nervous.

I've seen auctions postponed within an hour of the auction time.  What your agent needs to do is fax in an authorization to release AND note to the foreclosure dept at BOA as it's separate from the short sale department.  It can take up to two days to have the authorization logged though.  You have to do both steps if you have a property with an auction date.  I always send in the separate auth to the foreclosure dept as they can tell you whether or not they gave a stop order.

The listing agent should also be calling the trustee.  I hate saying it but you HAVE to constantly call everyone to make sure it gets cancelled.

Yes..and the Short Sale department usually can't even find the Foreclosure department which may be right down the hall..treat them seperately..

When submitting a request for extension, is it common for the automated response to be, "the request for extension had been made but that there are no guarantees". 

and...if on Recon Trust, if it shows a higher starting bid than the bank countered us, is it possible they are just going to let it sell at the trustee sale? 

Yes I've had it done one day prior and that's here in FL where they would say "new law stating we can't postpone within 10 day" lol yeah right!!
