I did a short sale in late 2008 with BankAtlantic being the 2nd Mortgage. They agreed to $2K at closing but I was forced to sign a judgement. I had legal counsel regarding this and was told they would not pursue the judgement UNLESS I tried to buy another home and then I would need to negotiate settlement regarding the judgement. I had heard nothing on it until this week when I got a notice from a collection agency that they wanted their money. Can they really pursue this?
They sure can, unless the agreement stated in writing that they wouldn't pursue unless you purchased again.
