Let me clarify... Sellers are current and going through divorce. wife moved out a year ago and lives out of state. Husband is self employed and makes good money. Freddie Mac declined short sales stating they have the financial ability to maintain the mortgage. We supplied them the divorce court papers that state the property must be sold and they still declined. How can I get Freddie to change their decision?

missing payments still not an option as income won't change and file still will go back to Freddie for decision
Freddie Mac many times will deny a short sale based on the fact that the borrowers are current. If a they were delinquent, the outcome may or may not be different depending on numerous factors, one being the household income.
This deal still has a chance to get done.
