I'm negotiating a Chase short sale with Freddie Mac as the investor and I want to share closing instructions that I was told are "fairly new." I only learned about the closing instructions the day before the close date and it was incredibly stressful to pull it all together so hopefully this will help you all be prepared. HUD%20APPROVAL%20Redacted.pdf

Our Chase closing agent told me over the phone that we need to overnight the following BEFORE they will accept the wire transfer (even though the HUD approval letter (see above) says they have to receive it within 24 hours of receipt of the wire transfer):

1. 2 original copies of the Arm's Length Affidavit notarized by 2 different notaries.

2. Notarized copy of the Waiver of Funds form.

Considering we only received HUD approval at noon the day before the close date, it was a scramble to meet their requirements. The short sale approval letter does make it clear that the ALA needs to be notarized but there is no mention that they need 2 original copies from separate notaries. It also does not say anywhere that the Waiver of Funds needs to be notarized. I closed a Chase short sale in April and they didn't even require the ALA to be notarized. I just faxed everything to the closing agent.

Has anyone else had this experience? I was told that it's a Freddie Mac requirement but I'm not sure if it's Freddie/Chase or Freddie across the board.

Thanks for sharing this Cheri. It was my understanding that Freddie quit asking for a notarized ALT many months ago. There was a time where it not only had to be notarized but all signatures and notaries had to be on the same document!!

Lenders just don't understand that every thing can't be done so quickly. We wait months for them and they give us hours.
