the short sale banks are saying that the Act will not be renewed, not sure if it is a collection technique or Not

Haven't heard a peep about this being extended. You should consult on the topic of "insolvency" with a CPA. True that the Mortgage Debt Relief act was an extra protection for eligible homeowners on their primary residence many who likely who were already considered insolvent.
