BofA set a task for a Trustee Release Form.  I have no idea what this is and they won't respond.  This has been 10 months of HELL on EARTH.  Please help if you can.  Thanks!

Sounds as though the property was in a Trust therefore there was a Trustee and if the Trust has been resolved there should have been a release of Trustee filed.

I have attached a sample form so you can see whats needed but your form in your state may or may not be different but you can use this to get some direction.

You may need to talk to whoever set up the Trust or there could have been a change of Trustee and the other Trustee is still on record..

If the seller filed for bankruptcy, the bankruptcy trustee must provide a release or "abandonment for sale" in order for the short sale to proceed.

Ok you did not say anything about BK, then what you must get is the BK atty must file a Motion to sell Real Property then when you get the short sale approved they must file an Order to Sell Real Property.

Now the lender can issue the approval in two ways first they issue the approval pending you get the Order to Sell real Property from the courts or they can say the approval will be issued after you get the Order To Sell Real Property from the courts in this case they must tell you what they will accept then you send the contract and HUD to the BK atty they will submit to the courts then the judge will sign an Order to Sell Real Property at this amount that the lender says they would accept.

Wait they can also say, here is the approval but it is contingent upon the Courts final ruling and Order To Sell.

FYI: The release cost about $400 to $900 depending on the heart of attorney you are working with at least from my experience in Sacramento, CA.  Shop around it does not have to be the same attorney that did the BK if they are going to try and milk your client.  The good thing is that they cannot foreclose while in the BK status so you don't have to stress out on this one!
