1. On October 25, 2013 a foreclosure notice was to clients. The foreclosure advertisement is attached published by Morris Hardwick. Per the laws the notification has to state the servicer and a contact number for the borrower to contact the servicer. This notification has be be published for 30 days before foreclosure. the notice states the servicer is OneWest Bank and the contact number is 800-781-7399. When the clients contacted the number they told them they no longer service the loan. The clients did not have proper notification who to contact in reference to their loan regarding the foreclosure proceedings.

2. clients starting receiving notifications from Ocwen regarding they are new servicing company around November 15th, the clients at that time contacted Ocwen and they assured her there was no foreclosure scheduled for the property.

3. client and I contacted Ocwen Loan Servicing by a conference call on November 22, 2013. WE were all assured during the conference call there was no foreclosure date on the property. Ocwen informed client they were eligible for a HAFA short sale. During the telephone conversation an appointment was set up for a relationship manager to contact me. I was given the email address for all the short sale documents to be sent to for the short sale to proceed. I was told a relationship manager would contact her on November 27, 2013 at 10:00am. No relationship manager ever contact me on November 27, 2013. In the email sent on November 29, 2013 the relationship manager name had changed but still the relationship manager has not contact

4. I emailed all documents to Ocwen with a contract and Preliminary HUD. I contacted Ocwen on Monday to confirm they received all  I there was no foreclosure date on the property. I called back in a couple of times to Ocwen short sale department on Monday November 25, 2013 still being assured there was no foreclosure date scheduled on the property.

5. I contacted Morris Hardwick  the foreclosure attorney on Tuesday November 26, 2013. They confirmed there was a foreclosure scheduled for the property  for December 3rd, 2013 and Ocwen had not notified them to postpone the foreclosure.

6. I contacted Ocwen Loan  back on November 26, 2013 relaying the information. They pulled all notes on the file. They verified again to theclients and I during a conference call had called in several times and each time they called in they were told there was not a foreclosure scheduled on the property. When I called what had happen on the file. They were putting in a postponement for the foreclosure due to how they had handled the file and had told the borrower for the last three weeks there was not a foreclosure on the property.

7. I contacted Ocwen on Wednesday November 27th they still could not find where a postponement had been put in on the file. They requested I Email the preliminary HUD to Ocwen while she was on the telephone and they would request a postponement since theclients and I was told several times there was not a foreclosure on the property. They said to call back on Friday morning and they should have received an answer.

8. On Friday morning I received an email from Ocwen stating the foreclosure was not postpone due to the foreclosure date. Please remember the clients were told several times there was not a foreclosure scheduled on the property which is documented in the notes of Ocwen telephone calls to the clients and I.back in for the 3rd time on November 26st, 2013 Ocwen informed her there was a foreclosure sale date on the property. They verified the notes and said they really did not clients were told several times there was not a foreclosure scheduled on the property which is documented in the notes of Ocwen telephone calls to the clients and I.

9. The foreclosure notice which was published by Morris Hardwick states contact OneWest which is not the servicer on the loan. The foreclosure notice was published for 30 days with incorrect information to the borrower.
