MY SELLER FILED BK-CHAPTER 7 ASSOCIATION DUES INCLUDED ON BK

THE ASSOCIATION ATTORNEY IS REQUESTING A FULL ASSOCIATION BALANCE PAYMENT AT CLOSING EQUAL TO $12,000, BUT MY SELLER INCLUDED THIS BALANCE ON THE BANKRUPTCY CHAPTER 7, WE ALREADY HAVE THE DISCHARGE LETTER.

THE ASSOCIATION ATTORNEY IS THREATING US TO FORECLOSE THE PROPERTY AND RENT IT OUT UNTIL BANK FORECLOSURES TO COLLECT RENT.

LENDER OFFERED $4k TO SETTLE THE ACCOUNT BUT THE ASSOCIATION IS NOT ACCEPTING.

It may not be wise, but the HOA doen't have to release the lien.  Try getting to the association, not the attorney, to talk to.  Obviously if you sell it, someone else will start paying now, before the association could foreclose and rent it.  Plus, they get an extra $4,000 now.  Since the seller is off the hook, prior to BK discharge anyway, they will come out ahead this way.

The seller needs to contact the attorney that handled the BK and let them take care of it. This is a legal issue.
