Need help! I'm working on a BOA SS that has a sale date of 6/11/12.  The mitigator just got back to me and said that the investor (Freddie Mac) won't postpone due to aged delinquency. BOA has verbally accepted the offer, MI just approved the offer as well. It was suppose to be submitted to the investor for an approval but she can't submit it because the sale date is so close.  The mitigator sent another request to the investor.

I can't believe Freddie Mac would not postpone for just 30 days when we are so close to an approval and ready to close!!

DOES ANYONE HAVE ANY CONTACTS AT BOA THAT CAN HELP ME GET THIS CANCELLED?  OR ANY OTHER SUGGESTIONS?

Try twitter @BofA_HELP or calling the office of the president. I do not expect BofA to be helpful, however. This is a political posture from Freddie Mac.  There are ways to get the foreclosure postponed but you need more, you need Freddie Mac to accept your offer.  You can try Freddie at 1-800-freddie, but I wouldn't get my hopes up. They do strange things that hurt everyone, so I don't see them being logical or reasonable with you.

Maybe your only shot is at getting your congressman to complain and put pressure on them to allow the sale to go through.  Logic has little to do with Freddie Mac, unfortunately.  Good luck!

Can you give us a status update on your above post re: your inability to postpone a Freddie Mac sale with B of A.....Did you have any luck postponing it? 

I have a similar situation with a listing on a BofA/ Freddie Mac mortgage with a sale set 10 days from now.  Did you discover any tips on how to escalate it to get a postponement?

Bankruptcy would stop the sale.

A good real estate attorney might be able to help.  Some states have "judicial" foreclosures and others do not.  In a state with judicial foreclosures, the sale is not final until ratified by the Court.  This can take quite awhile.  It could be that you go to settlement through the Court and ask the Court to overturn the foreclosure.  It gets complicated.  A good attorney will probably give you and/or your seller a small amount of consultation time without fee, or with a small fee.
