Any Suggestions on how to handle SLS? SLS increasing required Net to $8000 after approval from 1st...and after verbally agreeing to $3500

Hi All...maybe someone has run into this before...seems like SLS's M.O.

 

Short Sale, 2 loans...1st is Citi, 2nd is SLS HELOC.

 

SLS negotiator told me on the phone that $3500 would be the required net for them to release the Lien.  Once I have a HUD that shows that, and Citi's approval letter, send them both in to them for approval, which I do.  Seller is able to pay for difference between Citi's contribution and SLS required net.

 

SLS then tells me that $3500 isn't enough...now the want $8000, on a $33K HELOC?!?!?!  

 

Maybe this is more of a "venting" than a question...seems like they negotiated in bad faith and are now trying to create panic in the sellers eyes to do something stupid to close on time.

It sucks but until it's in writing and CLOSED they can pretty much do what they want. Unless the written approval is a signed and valid contract. The negotiator spoke before he submitted to MI. He never should have done that. All you can really do at this point is try to negotiate down. Maybe have the seller call them to discuss. Sometimes the borrower has better success negotiating these cash contributions than we do.

Azim, Ask why the change in terms. When you finish a conversation with them, repeat their points, ask if you have what they said correct. They do like to double talk and the negotiators use weak memories as a tactic. SLS can be tough in that regard. Since they state they record all conversations, you can ask for them to play back the recording, too.

Thanks Bryant and Wendy.  I do keep a call log for all Short Sales.  I know who I spoke with, when, and the details of our conversation.  I did call the Executive Services Department and they promised me a call from the department supervisor tomorrow regarding this.

I got the run around from the executive department and then when I tried to speak with supervisors in the department I was working with, Supervisors were always out of the office, etc.

 

They told me someone made a mistake by telling me $3500 was going to be accepted and "Nobody here uses the word Approval."  I told them 3 people told me the same thing and then listed the days, times and person I spoke with.  I asked then if they record their calls and I was told they do, and then asked them to play the dates and times I just mentioned and see what was said.  Of course they said they can't do that.  Their only suggestion was to bring in a higher offer.  At this point, when I asked for Supervisors, they were all mysteriously at meetings, lunch, out of office functions etc.  I emailed a couple and never got a response.  

 

The sellers decided to borrow $1000 more from Family and with some Pads on the HUD removed, they were able to offer $5100, which was accepted. 

 

At the end of the day, they are debt collectors who lied to get what they wanted.
