If they won't sign the listing agreement, maybe they would sign a warranty deed over? Then they don't have to be apart of the short sale at all or the listing. Good luck.

@jenny if the co-borrower won't participate, you likely won't be able to complete the sale. When a borrower doesn't participate in a short sale, it's most likely a deal killer.

So...very long and drug out story!!!  Currently trying to short sale after 3 years of mediation with WF.  There is a co-borrower on the loan that refuses to sign the listing agreement.  How to we move forward so we can avoid forclosure?  Is there a way??

Pass this information to your agent and you can tell your agent to call me and we can talk about how to approach the listing agent (the one processing the short sale)

Thanks Melody.  I am not a realtor but just a stressed buyer trying to get a house for my family and watching a lot of good regular sales pass us by!

WF is the worst! I have about 5 short sales that were all pending ATP's and I'm about 60 days out AFTER the appraisal has been completed so I feel your pain. Try reaching out to HUD directly and opening up a ticket. HUD will stay on top of Wells Fargo. You can also email HUD and confirm the variance has been approved. I take that email back to my negotiator and their manager as proof WF is slacking. [email protected] (you'll have to send in your letter of authorization first to [email protected] with the FHA Case # as the subject line, or you can email the LoA to the extension request email too)

Does anyone have any insight into how long WF short sales are taking in 2017?  We are 4 months into purchasing a short sale with 1 WF loan...our offer is in line with ATP, still no approval...Thanks for any help or advice!

Jim, I'm having horrible issues with Wells Fargo and appraisals.  I spent 3 hours on the phone with them, refusing to get off the phone until they found the appraisal I made them do and send it to me. Lies and games and 3 hours later they faxed it to me while I stayed on the phone to make sure it happened.  It wasn't until I told them I was calling the CFPB on the other line and my call to the local media was next that they helped me. I have to apply pressure and threaten every single time.

FHA short sale with Wells. ATP for price of $181,500 issued on 3/1/17 and good through 6/29/17, fully executed by seller and confirmed in WFC hands. Now WFC says appraisal is no longer valid and new ATP is needed with new appraisal of $205,000. Seems to me that the old appraisal is WFC's problem.  Am I wrong?  Can they unilaterally decide an ATP isn't valid anymore???

It's FHA. I've done hundreds of them. Literally hundreds. My escrow officer has closed Wells Fargo deals recently and didn't have all the grief I'm getting. Today I sent the loan estimate (I happen to know the loan officer and work with him frequently) and a combined ALTA. If this doesn't work I think the next alternative is the Exec Team. I really try no to do that but I may have no choice. HUD is useless to complain to because all they do is repeat what the lender says. Any great contacts would be appreciated. I'm getting to where I don't want to take on FHA SS's anymore but that's what a lot are right now. It was the next best option after 100% financing liar loans went away. Those are the ones that in default the most here. Those and the people who held out and rented their houses out that are now trashed by renters. Grr, little frustrated. Can you tell? :)
