Looks like if the sellers want to sell, they should pay the fee. No sense trying to get Chase to pay it if the sellers hired the negotiator.
Did the buyer really agree or were they told "in order to buy the house you have to pay a ss negotiator fee"? I see this all the time.
No the sellers hired the neg/lawyer as no one else wanted to list/short sale their home as the commission was so low and the offer vs outstanding balance at loan holder was significant (house in disrepair)
Took 6 months and to get the approval and it seems like Chase just doesn't want to follow through on their approval or see anyone else get paid (even though they always knew about this fee and agreed to let buyer pay it)
I agree with Tony, looks like the seller side needs to eat this, most likely the person who negotiated the short sale.
Marcia, so the listing agent was actually the one to "procure" the ss negotiator? In Calif it is an MLS violation to but that on as listing. And if the listing agents feels it is necessary to hire a negotiator then they should pay for it not the buyer.
sorry sellers hired the lawyer to neg - buyers agreed to pay bill
buyers have hired the lawyer and there is a bill to be paid - no lawyer is going to work for free or should be expected to
agents never would have done this short sale as commission to low to have to have negotiated with Chase on this (taken 6 months) - their time is worth something to
Buyers lender included in on GFE and prel HUD - nothing was ever hidden from Chase
Chase knew about this for 6 months and issued an approval with this fee - Chase closer is the one saying buyer can not pay a fee that is on buyers side and has nothing to do with Chase
So chase is saying they wont allow the buyer to pay the negotiators fee? The buyers lender financing the fee? Still not understanding, sorry.
The short negotiator, I don't believe it's an actual attorney, should already know that banks don't pay a negotiator fee. So what they were doing is playing games with the bank to get them to pay it. They should eat it!
Correct in listing the HO stipulated "buyers must pay a neg. fee"
This was in the listing and purchase agreement and on the prel HUD that the approval letter was issued for
