He has to participate.  Wife may end up needing to file BK as well.  I had a very close friend whose husband filed BK but then the creditors came after my friend.  She went to her attorney and the ONLY way out was to file BK as well.  In the end, it was the best thing she ever could have done.  She is now fully recovered, owns 2 homes free and clear, has an RV and is retired living a wonderful life.  Good luck !

What do you mean he BK'd himself off of the home? If the husband is on the loan you will need his participation. Yes, the short sale will be processed the traditional route with Chase. They will likely process this through equator and will require to see the bankruptcy was discharged. Melissa, same process as normal. You may need a copy of the BK discharge for husband and you will need him to participate/complete a Short Sale package even though he probably discharged the debt in his BK. Chad.

Little Help...Got A Chase Short beginning phase, husband BK'd himself off home, wife w/no income still on home, bk now complete...obviously Chase is now in petioning the BK Court to allow  Foreclosure proceedings to start..Help Needed is...anyone go thru this and do I process it still as a regular short sale? Suggestions? Thanks!!

I'm not sure if this will be helpful but when I've had discrepancies between legal title and the way the bank wants the HUD to show, I have been successful at getting the lender to bend to the legalities of the transaction. Many of the negotiators just don't understand the conflict and it needs to be escalated over their heads to a person who does. The name on the HUD is generally a matter of opinion for the bank and not a guideline.

Alright - HUD rejected. Need seller name to match as the note holder. They have reopened the task for us to resubmit.

Here are my options as I see it and I would appreciate any input.

Option 1 - quit claim back to the note holder name and see if the title insurance will still insure the property. The attorney thinks this may be an option per statue of limitations on the tax lien.

Option 2 - attempt to get chase to approve the sale with the current owner. I am not sure if this is even and option - but it sounded like someone who commented said they had accomplished this in the past.

Option 3 - assuming option 1 is no good, quit claim back to note holder and then negotiate a lien release with the state. This will likely take some time and is my least favorite option for that reason.

Any input or other ideas are welcome.

The agent tried calling several times all the way up to 6:00 EST yesterday.  Does anyone know what time they open?  He plans on calling first thing.  Is their any other advice anyone may offer to get the HUD approved for closing today?

There is only 1 loan and yes - sent via equator.  I will tell the agent to keep calling.
