Michelle, thanks for the quick response.... Here in CA they cannot collect a deficiency by law, if they approve a short sale.  They also cannot require Promissory Note or Cash Contribution as a condition of short sale approval in CA.  I do appreeciate the heads-up !

I have not dealt with them in this situation, but you should note that it is Provident's policy to NOT put deficiency waiver verbiage in their approval letters.  Just a heads up....

Has anyone closed a Provident Short Sale where the borrower is Deceased  6 months and the family just found out - And, an NOD was filed a couple of weeks ago ?  How difficult will it be to work with Provident?

Has anyone close a short sale with Provident where the buyer was a corporation?  I know some banks are not allowing that and I'm just wondering if Provident was one of them.

With regard to Deficiency Waiver and Provident....they do not and will not it.  Most of their loans are Freddie and since Provident is not the entity that would pursue the judgement, Freddie is, they will not release Freddies right to do so.  Stupid especially given that Freddie as a standard practice, commonly releases deficiency.  I have had 3 SS with Provident and Freddie loans and they have NEVER done it.  2 of my 3 sellers opted for foreclosure rather than to risk it as they were protected by Arizona's anti-deficiency laws in a foreclosure.  Just know going in that you are not going to get them to put the verbiage in the approval letter

I have an approval but they are not specifically adding the deficiency release. Has anyone had any luck in getting this completed in writing on the approval.

Also the homes has 2 liens but the owner wants to offer a settlement on the 2nd which has a balance of $7,000.
