What the summary judgment was and who the they is.

at summary judgement hearing they set the foreclosure sale date...we were able to postpone it.

I was hoping you were going to say you got a summary judgment against them and they agreed. See what you did? Now I have to cry. I can dream.

Here's a thought and a strategy I have employed.  We all have to be authorized by the borrower to speak with their lender / servicer (3rd party authorization).  That would be the same for Auction.com .  Do you have written authorizationfrom the owner / borrower of the property to discuss their situation / loan / property / sale of their house with Auction.com - probably not from the sound of it.

When I get called by Auction.com, I let them know I am not authorized by anyone to discuss any property with them just like Nationstar would say to you if you were not an authorized 3rd party.  If Auction.com needs to discuss a particular property, they should contact the owner of that property.  When Auction.com says they have been engaged by Nationstar, I always say "that's nice but you have not been engaged by any of my clients so I cannot speak with you.

wish i would have thought of that.  seller verbally authorized me because he was extremely concerned about having a sale date set at the summary judgement hearing which we were able to get postponed however he had already signed agreement by then.

Thom, good thinking regarding obtaining authorization. This madness that continues must be stopped and by us continuing to fight for our customers by putting up our road blocks this will not be an easy road for those trying to put their foot into the business of Real Estate by trying to change the rules for them to profit. 

Thom and Lynn, Not only does Auction.com not have a third party authorization from the seller so we as agents can not speak to them, Auction.com should in no way be speaking with my client as I have an Exclusive Listing Agreement and if they do I would report them for ethics violation.

Beter check your original mortgage documents and see if theres an implied authorization granted through the lender. The documents like insurance policies can change over time so youd have to see the applicable years documents for 1999 for example.

I think you will find REDC / Auction.com / all of their other entities are members of the MLS but not Local, State or NAR - so non-Realtor Members.....  Just an FYI

2 things -

1)  Someone needs to step up and just like an efective short sale escalation - GET THIS ISSUE TO SOMEONE THAT CAN MAKE A DIFFERENCE!!!   Get this issue to a decision maker.

2)  I can only HOPE there are attorneys out there frothing over the potential class action lawsuit on the Auction.com issue!!!

Great comment Ben but in something this big involving so much money willing cooperation looks doubtful.

 

Dont hope. Push it. Your organizations should be fighting the batte for you. There should already be paper filed.

You have unlicensed people sitting in a bank conducting real estate transactons and you let it go on.  They have few rules and even less accountabiity and you let it go on.
