Received an e-mail from Wells Fargo stating that there are 5 liens on title for my client's home.  At time of listing the home I had my title company pull a title commitment and we found 2 liens both are associated with the HOA and I knew this at the time of taking the listing.  In the HUD I included the outstanding HOA liens.  Wells Fargo typically covers up to $2500 in liens.  When I received the e-mail I replied back and stated that we are aware of the 2 liens and that we verified that the 3 other liens are  not my clients.  I included a copy of the title commitment and asked for direction on how Wells Fargo would like us to prove that the other 3 liens are not my clients.  I received no response.  I sent another e-mail asking for verification of receipt of the title commitment and if that will cover all requirements.  No response....  Monday I call and I'm told a Same Name Affidavit is required.  I call my title company and the next day I send over to Wells a notarized same name affidavits for each of the liens that are not my clients. 

Today I find out they closed the file and that I need to get payoff letters from the lien holders.  How the heck am I suppose to get a payoff letter that 1. is obviously not paid off if it is showing as a lien and 2. is not my clients!

Anyone have an escalation person I can get a hold of?  I've cc'd the customer service manager in my reply back to the Loan Adjuster Specialist working the file.

Did the seller complete a statement of information for title ?

Have a title search done and send them the report.

Title needs to get involved.

Oh my gosh, I had the same nightmare with one of my files!!!  It was time-consuming and ended up adding another couple of months to the process because Wells would not re-open the file because of supposed title issues.  I could not get through the thick skull of my negotiator, or anyone else at Wells. :(  We had title company prepare an "affidavit in aid of title" stating the liens in question, complete with case #, book and page #, etc....My particular file was an FHA file, so I did get an assigned rep involved on that side, which was VERY helpful.  Message me for contact info at Wells...maybe I can help!  I completely understand your nightmare!!

Same thing happened to me.  we had to file a "lien" affidavit.  What cracks me up is the EXACT same thing happened to me where they asked for a name affidavit which we provided then they closed the file.  I had written confirmation on the title co's letterhead that the liens were NOT the seller's and they still closed the file.

 

We got it reopened by going to the manager above the negotiator and provided a lien affidavit.
