12. Flagstar Bank, F.S.B., Troy, MI [Docket No. 12-1436-MR]

Action: On November 21, 2012, the Board entered into a Settlement Agreement with Flagstar Bank, F.S.B. (Flagstar) that required Flagstar to pay a civil money penalty in the amount of $37,000, and pay $92,677 to indemnify HUD for its losses with respect to one FHA loan, to indemnify HUD for any loss (past, present or future) on five FHA loans for a period of five years from the date of the agreement, and to retain and fully pay for a third-party servicing monitor for a period of one year, without admitting fault or liability.

Cause: The Board took this action based on the following violations of HUD/FHA requirements alleged by HUD: Flagstar failed to engage in loss mitigation, failed to service FHA loans in accordance with HUD requirements, and failed to offer property disposition options to the mortgagors.

Does anyone have contacts at Flagstar with some pull? won't extend approval, offer 50k higher net than investor Fannie needs. auction set for 7/26. Loss mit just says we need to submit new package. "Flagstar doesn't do extensions!?" "Fannie won't postpone"

Flagstar sent my home to auction. We had signed HUD 1 counter offer complete. My negiotator was a complete "Expletive" (insert whatever). She told me on 6.24 that the trust sale had been posponed. She is now backtracking and saying she never said that. I have all my communication . Flagstar bought it back at auction for 30k more than it is worth.

I have been working with Flagstar since Jan. My negiotator is Patricia Churilla she seem extremely unorganized. I finally got a counter last week and responded next day and now I am in a waiting mode again. I just want the approval letter darnit!

I have been working on a short sale with Flagstar since October 09. It took forever to get the them to approve. Then they sent it to Fannie and they came back with a counter $30K over the offer. We settled at $25K over the offer pretty sure the appraisal would come in lower. It did by an additional $11K. The incredible thing is that the buyer is using Flagstar for the new loan and it was their FHA appraiser. We sent the appraisal in and our negotiater after nearly 2 weeks informed us that she had to re open the file, order new BPOs and title report even though they have an appraisal from their own appraiser. She said that once a file is approved it is closed. She said she has other files ahead of us and we have to wait our turn! Like either one of those items are that time consuming. Then the buyer decided that they would just pay the $11K out of pocket. When I informed her of that, she emailed me back hours later that it still had to be redone because the first approval had expired. Had she replied to me 2 weeks earlier we would have been with in the time frame. Now it has been a total of 3 weeks and she still has not replied to my last email or to my knowledge ordered the new BPOs or worked on this file. Is there a supervisor or some one I can contact? I can get a reply as to the status. I feel so helpless and I have been nothing but extremely polite and respectful to this negotiater in hopes that you get more flies with honey if you know what I mean. I am afraid to be too pushy that they might just throw my file in the trash or behind the desk. I would appreciate any suggestions that is if any of you have had a good experiance! Thank you!

WOW. Im reading about agents experiences here with Flagstar and I must say I have NOT experienced this.

I have had 3 experiences with flagstar, 1 they were the first and 2 they were 2nds. when they were the first we had an approval in 5 weeks. (my team and I talked to them, no matter what they said, 3 times per week though). When they were 2nds, roughly around 8-10 weeks. I cant remember which was 8 and which was 10 as these are over 8 months old but.....

How quick is Flagstar when it is a junior lien? I have one I need approved in about two weeks! Also, what do they ask for on the junior usually? THANKS

I've been working a short sale for the past 4 months with Flagstar. The negotiator is rude, never returns calls and doesn't seem to understand we now have a foreclosure date. I've asked for a supervisor and that hasn't worked. The sellers just hired an attorney in the event we don't have an answer by the foreclosure date. Has anyone had this much trouble with Flagstar?

Yes, just closed this morning. Was supposed to close Monday but the buyer could not close until today. One of the owners had passed away and Flagstar made the owner go through probate (probably looking for any hidden assets) because she had received a life insurance policy Flagstar originally wanted a $25K prom note and $25K cash at closing which nI negotiated down to $5K cash at closing and no note. They are very quick, my first buyer backed out and the next offer I received was accepted and approved in 7 days.
