Have any of you Texas agents filed a motion to postpone a foreclosure at the courthouse?? I had a homeowner call me this past Wednesday. He has a foreclosure date of 5/1/12!!!! I told him I couldn't guarantee anything but I would do my best. Lender is BofA. I put in the authorization and immediately started marketing desparately trying to get an offer. Additionally I put in a request to BofA to postpone so I could have a chance to sell the property. Just got word request was denied. Can I file a motion at the courthouse on Monday to postpone? And if so, what do I need to do? I am still trying to manifest an offer through this weekend. Any advice would be so appreciated!!!!!

Have the seller file for bankruptcy and then pull back so the bankruptcy doesn't show on their credit report. I told one client to do a 13 because you have two weeks to back out and he told me that the attorney he talked to said that was smart, but he can do the same with a 7. So he did that.
Also, if you are going to do a short sale, you better start working with investors to slam in an offer in tight situations like this. Call those "We buy houses" people and start building relationships to weed out the bird dogs from the real players.
File a motion? Are you an attorney? Attorneys file motions. The seller needs to hire one asap.
Should have been more specific....was going to have his attorney file a motion but wondered if a motion could be filed just to give us more time. Not that there was a specific error in regards to the foreclosure. Thanks for the response.
well, i guess, this one's out of the hands of the agents. What the clients needed in this sort of problems were the attorneys and people in that related field. I t would be the best if you seek for their help. And then you can make a better plan on how to deal in this problem.
Yup....If he would have come to me a couple of weeks earlier, I could of helped maybe. I passed along everything to his attorney to see if we can get it delayed. Not looking good though. Thanks for your reply
