This is a short sale.  BofA is the servicing agent.  Don't know the investor.  Seller has FHA loan.  I work for sellers agent.  BofA is demanding a very high price for this property (which may kill the deal) and I want to check the appraisal.  Bank refuses saying that "it's an internal document" and they are bound by "notace of righ to receive apprisal" (sic)  Mortgagee Letter 2008-43 seems to me to grant the homeowner and the Agent a copy of the appraisal. 

Am I within my rights to get a copy?  All I really need is the actual appraised value and the date the appraisal was conducted.  Can I get that from FHA/HUD?  I guess I could file a Freedom of Information request.  Any advice?

You can:

1.) Call your local HUD regional office and file a complaint. Tell them that the servicer is being non compliant with HUD guidelines for the PFS. http://portal.hud.gov/portal/page/portal/HUD/localoffices

2.) Send them a copy of the PFS guidlines: www.hud.gov/offices/hsg/sfh/nsc/rep/pfsfact.pdf

I always like to use Adobe, then I can highlight and add big circles and arrows, just like behind the register at McDonalds. I equate the two very closely when it comes to B of A.

It also depends who you are talking to. If you are talking to SS support they might not be trained so they dont know they have to disclose that information and actually give you the min net requested and appraisal amount. If thats the response you are getting from the negotiator you can file the complaint through FHA but I would contact the negotiators manager and that might be faster than the complaint. Try both simultaneously. Most short sale support reps dont know what they are doing half the time. But the negotiators are supposed to be FHA certified.

It wont delay things, if anything it will speed it up. what happens if FHA will contact BAC and then someone will call you. Or if you talk to a manager in BAC without going to FHA it will have the manager contact the negotiator and the negotiator will review your file. You have to realize each negotiator handles between 200-500 files. So a situation like this will bring more attention to your file. Take advantage of it!

The buyer accepted the BofA offer, BofA said okay and they go to settlement mid April. BofA negotiator is now finished with her part.
I think it's water over the dam now.
