I have a short sale listing that has been listed for 99 days.  I got an offer and submitted it on equator in May.  They said it was HAFA eligible and transferred to HAFA department.

Now HAFA is saying they are not eligible and to resubmit it back as a regular short sale.

There is an auction scheduled for Wednesday! and they are now saying that the INVESTOR behind the scenes is saying that they will not postpone the auction.

I really need all your help and support to help this single mom with two daughters.

Who can I call/email to get this escalated to simply postpone the auction.

I am willing to resubmit the package and go through all that.  Buyers are still on board.

We just need time for THEM to process the short sale.

Did you or your seller receive a written response denying the HAFA eligibility?  Who is the investor?  If you can determine the investor, you may be able to contact them directly to make sure they are aware of what the servicer is saying and inquire why they would prefer to foreclose.  If they won't tell you, the seller needs to call and find out.  The seller also needs to call and ask for the cooperation of getting her sale postponed. In the meantime, follow their directions and reenter the loan number into Equator and see if it will upload.  If it does upload, upload your authorization and then immediately upload your purchase contract! (You can do that through the message center-attach) CAR also has a website for short sale help so you might want to contact them directly or through their website and they may be able to assist.  Finally, your single mother might be able to consider filing a bankruptcy (which she could withdraw later) and that would halt the sale temporarily - that is the least preferred method since it involves the seller paying some legal fees.  Call me if you want to discuss further.

 

If you haven't already gotten this one from the group, try to tweet bofa_help.  Someone else on this forum mentioned them and I used them successfully on three different occasions.  They respoind VERY quickly.
