This property closed over one week ago. I just received an email from negotiator asking for a notarized copy of the Arms Length Affidavit. This was never brought up during the full approval process. They have a signed copy without notary. Anyone else have this required?  And, I guess, I am letting you know to have it included in your closing if not...just to have it covered!

Yes, there is always an Arm's Length and it aslways needs to be Notarized.  Even if you haev to have all of the aprties do a separate document in "Counterpart" - that will suffice.

 

Better get it done ASAP or they will reject / return the funds to the settlement company.

Most of the time they need to be notarized with most lenders, so I just get it done automatically. I am even seeing some lenders want the 3rd party Auth notarized!

Best practice is to ALWAYS get the arms length affidavit notarized to save hassles later.

Yes, I have had many Third Party Authorizations notarized ... but not the Arm's Length on many. I have used a generic form I typed up and never have been asked before (last two years) for notary. But, will change so it is notarized at closing since many buyers agents use docu sign.
