"Bank mortgages typically have clauses that allow them to preserve a property they determine to be abandoned.  So yes, they have a right to do it if the property was deemed abandoned by the bank."

I have a listing with owner of record having no public notice of sale issued either recorded or published. A contractor for the bank called on my sign and requested access, threatened to break if not granted. My client said not to provide them access and tells me he's current on loan. Either way delinquent or not, does a bank have any right to force access to a home they don't own?I'm in Arizona, this is a deed of trust, and I cannot find anything in statute / legal code saying they do. Hello Matthew,

I found you on Short Sale Superstars where I am also a member.  I have a situation...
I need a "Referral Agent/Agent of Record" for a short sale transaction.  I have a local client here in California that owns a property in Tucson, Az.  She made a deal with my family (parents) to purchase.  I personally am a short sale agent here in Los Angeles and she wants me to handle the entire negotiations with the bank, as this has been my specialty for many years.  
I have a purchase agreement signed on local CA docs and a full entire short sale package already submitted to the two lenders on record.  It is an inexpensive town home.  Seller is delinquent on both 1st and 2nd so we have submitted short sales to both lenders, however, the Buyer is prepared for the 1st to decline due to payoff balance so Buyer is willing to pay the 1st in full with penalties, so we are only looking to really short sell the 2nd.  Its pretty straight forward.
What we are looking for is a referral agent/agent of record since we already have a buyer in place and a contract signed.  You provide local paper work as needed and I do all the negotiating with the banks.  If you are open to this, I will send you a Broker referral agreement for XXX% and a copy of our Purchase Agreement to be redrafted on Arizona paperwork.  I will also ask you for an Escrow/Title company you work with so I can send them a copy of the contract to get an est. hud.  I think the only other thing would be to make an appointment with the occupant once lenders want to schedule their bpo.  
I expect there to be minimal work on your end...  I am already on file with the lenders as the 3rd party authorized negotiator.  Make sense?  Please let me know and if you are willing, I will send over paperwork asap.  I need to get an AZ contract back asap to request an Est. HUD from your escrow as requested by the lenders asap.  Thank you.
