Working on an FHA short sale. Received the following request today from the WFC processor: "I am stuck on this file right now, I need Bankruptcy Attorney and/or agent to obtain the court consent to sell property. There is a discharged chp7 from 09-09-13."  I've done lots of short sales but I've never received a request like this before. Why would we need a court consent to sell if the BK is discharged??  I would think the court has no jurisdiction over the matter after discharge but I'm no expert. In December I closed an FHA short sale through Bank of America that had been discharged through a Chapter 7.  Neither B of A nor HUD/FHA required anything relating to the BK.  I asked why this was needed and he just responded "I cannot proceed without it." Nice.  Thoughts from the smarter than I am crowd?

the Veteran has a right to a copy of the appraisal.

I have had a VA short sale for almost a year now. It's been approved twice now but the most recent value is so far off the mark it is ridiculous. I have 2 cash buyers willing to buy at the approved price from the previous appraisal which has since expired. The whole thing has gone south and the buyer wants to challenge the value. I got stone walled from the negotiator and cannot get my hands on what comps were used by the most recent appraisal which is $60K off the current offers and valued very close to retail not taking into account the continued deterioration of the property. Any suggestions would be appreciated as I am contemplating taking a package to the local VA office to dispute. thoughts?

@Robert Drakeley, I just used the address that the sellers used for their most recent tax return, in this case it was the property that was being short sold, even though they had recently moved out of the property

IS THERE A CORRECT ADDRESS TO INPUT FOR WELLS FARGO ON THE 4506t?

there is no specific timeframe for them to send an ATP.  they should provide you with a copy of the appraisal upon request. this usually takes some doing with Wells Fargo though (i.e., red tape).

Thanks Wendy -- also they have not sent the ATP and when I requested them to send this their reply -- We have decided not to send it yet

Whats with that?  Isn't there a time frame they would have to send you the ATP??
