I have a very unique situation.  Chase is the 1st and the ex-wife is the only borrower on the loan.  PNC is the 2nd and the ex-husband is the only one on the loan.  Ex-wife is the only one on title.  Divorce decree requires ex-husband to sign whatever is necessary on the 2nd.  Have approval on 1st. Ex-husband isn't cooperating.  She doesn't have money to hire an attorney and is in fact getting ready to file Ch 7 BK.

According to title - they say she has all the legal rights necessary to close this transaction and we don't need the ex-husband.  PNC underlings say they need all of his paperwork.

I need to get a hold of the legal department at PNC and see what I can do.


I would appreciate any help I can get.

Amee worked a 2nd for me and was very helpful - she may at least know who to get you in touch with.  I would also try to get a judge to give Mrs. a Special POA for this transaction...

thanks for the info Kevin. I am having a PNC issue of my own, which is why I am here looking. You always seem to have all the answers!

Suzanne--as an alternative to Kevin's option, if you can't get anywhere, PNC Bank has a Twitter group that helps out with 2nds. We haven't used them yet, since we are dealing with 1sts at the moment, but we've had great success with the other banks' social media escalation teams, especially BoA. I know this information is very late, but if you are dealing with a BK, I thought you could still be working on this one. Good luck!

I have been on the phone back and forth between the Executive Office and Loss Mit since my last post trying to postpone a sale for tomorrow. The were really no help at all. They pretty much deferred to the Loss Mit Dept decision not to postpone. They keep saying that the investor won't allow a postponement. I don't believe it. PNC has a reputation for not postponing, and they would rather dump the file to the foreclosure dept. Plain and simple....
