PACKAGE REQUIREMENTS:

 Please complete, sign and return the Request for Transcript of Tax Return (IRS Form 4506-T) for each borrower (borrowers who filed their tax returns jointly may send in one IRS Form 4506-T signed and dated by both of the joint filers).

 Please return a signed and dated copy of the most recently filed Federal Tax Return with all accompanying schedules

 Please return a signed and dated Hardship Letter.

 Third Party Authorization Form

 Listing Agreement.

 Anti-Fraud Agreement

 Sales Contract (Electronic Signatures not acceptable)

 Arms Length Affidavit

 HUD1 or Settlement Statement

 Please complete, sign and return the Hardship Affidavit and Financial Form OR Request for Modification (RMA) OR Uniform Borrower Assistance Form (UBAF).(Check Vacate Property)

 Please return Last 2 months bank statements for any and all checking, savings, money market and or brokerage accounts held in borrowers’ names.

 Please return a completed, signed and dated Financial Worksheet.

 Proof of Income (Most recent Quarterly Profit and Loss, Last 2 paystubs showing year to date earnings, Social Security, or Unemployment Benefits Statement showing amount and frequency of payments)

To get the latest short sale package from PHH mortgage, your customer needs to establish an account online.  Go to: http://mortgagequestions.com   This is where you create the account.  (It will require name, SSN, loan #, birthday, email, password, and three security questions, such as elementary school, pet's name, highway closest to your house, street you grew up on, etc.)  Once this is established, it has his or her account information and you can print out the short sale package.  I had to print it out and then scan it in -- couldn't seem to save it directly from the site.  An alternative to faxing in the package is to email it to: [email protected]  .

I am happy to report this PHH Short Sale CLOSED.

Sale price: $94k; Commission 6%; Contributed to Buyer's cc/ppy of 3%. No promissory note. Seller was active duty military.  This was our 2nd contract -- buyer walked on the first one after three (3) months. I'll try to relate events in reverse order:

CARTUS is the company who works the short sales for PHH.  They were very good. Donna H. was their negotiator and I can't say enough good things about her.  Once everything was in her hands, it took 2 months -- and it would have been faster -- except we kept having to work things out between buyer and seller due to it being an FHA loan.

The difficult part was getting everything from PHH to CARTUS.  I had downloaded their pkg. as indicated in an earlier post -- but they kept "losing" it.  Then when they finally got everything, apparently some of the forms had "changed" and the seller had to fill out updated ones. (They didn't seem any different to me -- but we did it anyway.)  Anyway, it feels as if that took absolutely forever, but FINALLY the pkg was turned over the CARTUS. 

Guess what - CARTUS had their OWN forms -- so seller had to fill out everything AGAIN.  Once we reached that point, honestly things went very well and I was pleased.

(The buyer walked shortly after the BPO came in, but we got it under contract again fairly quickly, so it didn't affect the process.)

I must also say that the agent for the buyer, Carrie R. did an excellent job -- she was very cool when we had to work some things out and I feel this was truly a team effort.

Well PHH is definitely one to watch out for.  Its been 90 days with a cash offer for a military active duty owner transferred due to orders and still no resolution. Cannot talk to anyone except Loss mitigation.  Promised call backs but not thus far.  Any ideas of how to talk to the short sale dept.?? Please help.

I tried, unsuccessfully, to help my client negotiate a loan mod (on a non-owner occ property...need I say more?), but client just received a "notice of intent to foreclose" in the mail today and wants me to list & begin a short sale.  Just wondering if any of you can tell me what the typical timelines are for your short sales with PHH?  Also, we have a tenant in the house...anybody have a similar situation?  Should I be putting $3,000 in net sheet for tenant?  THANKS~!

I received another email from an actual person who informed me that the package had been sent to the loss mitigation dept for review. No personal contact info yet, though. I'm keeping a journal of this process.

OK -- I'm sure it was automated, but I did get an acknowledgement of my email. It said someone would contact me within 24-48 hours and they also gave me a tracking number.  We'll see.....

I sent a very complete package in today via email.  I am very curious now to see how this will go.

PHH is a paperless office.  They want all loan numbers on TOP of any fax pages to work with their system.
