Thank you Kevin!  I sent them a generic LOA and they are proving to be a tad difficult .  It was originally serviced by BAC and right after I started the short sale in Equator BAC transferred it to Seterus.  I've spent a week just trying to get this part going.   They have all short sale documents unless they come up with some new requirement. I hope it gets easier from here.

Sarah,  The Servicemember Civil Relief Act doesn't prevent a Servicemember from being foreclosure upon, it does require a Lender to take certain steps to do so.  

The Servicemember Civil Relief Act requires active duty soldiers be informed of civil actions like foreclosure, and allows them to delay the process until they are home to defend themselves.

Hey Everyone! I was wondering if anyone had an increased luck with This servicer since the changeover, or if it was just a "rename". I have a short sale with them right now. no offers at the time, but we had one last fall - at the time, LBPS countered HIGHER than my list, and buyer took it. they backed out because of issues that came up in inspections that LBPS woudn't repair or credit for. etc.. the seller is protected under soldiers and sailors act, so they cant foreclose. they had the seller ok with a 20k promissory note, and STILL wouldn't contribute 2k for loan required repairs). Since then, the area has declined even more, and I'd love to get it sold, but apprehensive to go lower on price due to LBPS's stance. If anyone has any words of advice, I'd appreciate it :)

The main problem I have with Seterus is it cuts your commission so it can pay a third-party vendor. They also ask for those fees to be in the 500 series on the HUD. Don't ever do it because then you could be accused of paying a commission to an unlicensed entity. Those fees belong in the 1300 series.
