Looking forward to closing many short sales 2017. They are a beast, but have to be facilitated to Closing. :-) It is definitely for the greater good.

Nedy - I have not run into a homeowner telling me a "fast" Florida foreclosure story, yet.  I hope we get comments from others in Florida.

Thanks Wendy, I read the part about timelines and he is saying 5 months.  What are you seeing? It's in line with the one I just saw that took 4 months.

Florida Fast Track Foreclosure....since its implementation have you noticed if the timeline is actually shorter than before? I just saw one today, lis pendens filed in April 2013 and foreclosed August 2013.  That's 4 months!

Gabe- The court does not have to agree. The trustee can make that determination. I am not an attorney and I am not giving legal advise.

Kim- we do short sales for those in bankruptcy all the time. In fact, we are carving out a bit of a niche in that area. We just had a listing for over 2 years now with Countrywide/aka/BOA where the second lien holder is Etrade- the worst!- and after the first year of going through numerous offers and Etrade not budging- our sellers filed bankruptcy, not just because of the house, but they made too much money for a Ch7- so their bankruptcy attorney had to take the house out of bankruptcy filing, we still worked the short sale, then Etrade would not deal with us until after the discharge even though they were pulled out of the schedule. What their attorney is going to do is have us close on the short sale and then take their deficiency and put that into the bankruptcy because that will fall within the amendment period. We are finally after 2 years getting close to resolve.

You'll need to contact the Bankruptcy trustee and have them sign off on it. It should be OK to take the listing but the bankruptcy may complicate it a little as the trustee will need to have the court agree to the sale. - Disclaimer here that I'm not a lawyer and I may not know anything about this. :-)

Just so that I am clear.......Is it feasible to proceed with a short sale for a customer that has just filed for Chapter 7? My customer says she did so after advise from her bankruptcy attorney but now she wants to sale her homesteaded property. Would it be ok to take the listing?
