FHA Contract Clause

"Sale is contingent upon the seller receiving prior written approval of Insert Name of Lender/Servicer."

FHA Listing Agreement Clause

“Seller may cancel this agreement prior to the ending date
of the listing period without advance notice to the broker, and
without payment of a commission or any other consideration if
the property is conveyed to the mortgage insurer or the mortgage
holder.” The sale completion is subject to approval (under HUD
guidelines) by the mortgagee.

thanks for your help.  i just don't understand why i escalate to hud when bank of america doesn't seem to care.  i mentioned the name of my negotiator and his supervisor to the hud counselor and she said she had received a lot of complaints about the supervisor - WHAT???  if you have a bunch of complaints, why doesn't anyone do anything about it?

I was having trouble with one of my short sales and found out that by complaining to the OCC helped. We had an offer of $539,000 and their own appraisal came in at only $510,000 but the servicers were giving me the run around. The last conversation before reporting them was, well we don't have to do a short sale and do what you want we can foreclose. I turned them in and now after nearly 5 months have an approval. Amazing we may actually close this thing. You can go to this web site www.helpwithmybank.gov  for information and to file a complaint.

meanwhile....on another FHA shortsale I am working - does Bank of America even want to do FHA shortsales???? i'm no the phone with hud, i keep escalating to them, they send me back to the b of a hud escalation team - which is a JOKE!!!  how do i get out of this endless loop of escalation going NOWHERE!

if it is vacant its okay but they need to keep the utilities on.

oh yeah, they still are paying for utilities and upkeep of home.

no, i am the listing agent.  when the seller contacted us about doing a shortsale, she had already moved out of the home.  so, i am just trying to figure out if it is still a requirement that the home be occupied.  it was owner occupied until november of last year, but the sellers moved out.  now property is vacant - is that a problem?  thanks for response.

HELP!  I am a bit confused.  I thought there was no longer an occupancy requirement for HUD/FHA homes.  Didn't they get rid of this requirement in June of last year, or am I thinking of something else.  Thanks!!!!!!!!!!!!!
