Anna and Diane - sorry for the tardy response. Been taking care of off-line tasks! ;-)
Our strategy of dealing with HOA Mgmt Co.'s and their Board of Dir.'s is same as Katerina's in FL. We are a Trust Deed state like Cali but state laws regarding HOA may be different. To be honest, I've never really researched the laws and relied on them much. I've just written the HOA Mgmt. Co. a nice letter/email explaining the hardship situation and the fact we need a discount to get a new "house proud", HOA paying, owner occupant in the property and they invariably give us a 30% to 50% discount. Good for Katerina getting a 70% discount - you go girl!

Anna- We negotiate with HOA based on our laws here in Florida which of course are not going to help you in CA due to your HOA laws. But even so, you can negotiate that now they can get some money for their HOA and have a new resident instead of the house sitting vacant and the stigma of another foreclosure in their HOA neighborhood. We have negotiated down as low as 30 cents on the dollar to 75 cents on the dollar. Like I said, here the lender is only going to have to pay 6 months of HOA fees when they take title. Florida is a deed state, CA is a trust deed state. So you would need to just use the fact that the house will be occupied by a new person who is going to be paying their HOA fees and if they don't reduce the fees, the sale is not going to happen.

Anna... short sale is through Chase who authorized seller to seek buyer. Originally listed for 111k, then 91k, later 73k. No lst and 2nd. Hardship is only 1 job now... not enough $ to maintain mtg. Offer is $60k cash

Whole purpose of short sale is for seller not to pay closing costs and not to have foreclosure. Deed-in-lieu will show up on their credit as a foreclosure...
Who is the bank? Is there a 1st and 2nd? What is the seller's hardship? How much is owed on each loan? What's the offer amount?

Seller lives in GA, property is in Illinois.... they ALSO do not want to pay money at the close, and would prefer if they could do a deed in lieu. The offer is cash and buyer is ready to go....

can they avoid paying closing costs???

Depends on what state they are in I think. Here in Texas, we definitely do this WITHOUT an attorney. I'm the one who negotiates with the Bank and the HOA Board of Directors regarding HOA liens, late fees, penalties, etc., on my files. Which state are you in?
