I contacted CMS to submit short sale, I got a reply saying that all they need is HUD,listing and POF and not to submit to them they will have this company by the name of SPURS call me.

After 2 weeks of CMS playing games with me telling me don't worry "SPURS" will call me: I get an email today saying they have been in contact with the seller directly and they will do a deed in lieu and would not consider a short sale at all.

The seller said CMS did call him and offered him $15,430.00 to do a deed in lieu, and they will satisfy the 2nd(Chase) and the 3rd(private mortgage).

How is this OK? I do not understand why these banks are getting away with these underhanded deals.

I know very good deal for the seller if they satisfy all the liens which includes water, violations from NYC DOB,ECB- it amounts to over 30K, cutting a check to him is great but will they take care of everything else? NO answer given as yet, with a short sale all of these things are satisfied at closing, will it work the same way with a deed in lieu?

I advised the seller to take any paper work to his attorney for review, will post update once we get an answer: I still think this is shady business
