Richard- I want to see new letter too! Awesome! Yes-got short Sale def - I send anonym-ized approval letter to my BOFA sellers when I get listing so they are forewarned!

Richard, That's interesting that you received letters with release of liability. If you want you can scratch out the personal information and load those on this site. That little piece of paper icon on the tool bar will load documents.

I'd be curious to see them. It's completely contrary to what BoA says. Maybe next time they say "we can't" we can send them over one of these letters and say "well you did here"

As a follow up - ON THE OTHER HAND - we also got (surprise!) two BoA letters last week with complete releases of liability!!!! This is absolutely contrary to all the other letters the past 2 months. I have made a copy with redacted information and send to the BoA negotiator when they tell me their ultimatum.

Bank of America is turning a page on its past history as a deficiency waiver lender. Now (as of June 1) their policy is to NOT waive but specifically reserve the right to a deficiency.

But first, Wendy - a short sale approval letter is just that and don't be confused with the old definition given by the Associated Press that a short sale meant that the loan was being forgiven. The true definition is that a short sale is the release of the lien of the mortgage for less than (the "short") the amount of the mortgage indebtedness.

Although the article is dated, the information still holds true - see my Active Rain blog post at LENDER SHORT SALE ACCEPTANCE LETTER EXAMPLES - READ WITH CAUTION!
Short sale acceptance letters are a trip! Interpreting them requires a legal degree and years of legal practice - and it shouldn't be so! They should be in plain language written by knowledgable people that can write English. Many lenders use letters that my 5th grade English teacher would have graded with an F.

CANNOT BELIEVE THIS BOFA says they have APPROVED from a submission on July 2!! not a government loan, one lien... BUT this was submitted three months ago and buyer walked then.... YIPPEE!

Bank of America issues approval with WRONG terms... Previous negotiator does not know how to READ I guess!! all of a sudden no past due HOA are paid and there is now a promissory note! GREAT
