So my seller called me today after she called BOA for an update.  She found out that someone named Rhonda has been calling on her file and BOA has been talking to her!  None of us have any idea who this person is!  BOA had in their notes that any file updates and questions were to be sent to her e-mail address.  My seller got her name and e-mail address from BOA.  She told them that they were NOT ever allowed to talk to this person, it sounds like she had represented herself somehow as their agent.

 

Has anyone else had this happen?

 

I have e-mailed this Rhonda (no it's not the buyer's agent), and she verified that is the name of the e-mail owner, however, she's being sketchy as I try to ask her who she is and what her interest in my listing is.  She wants to know how she expressed interest in this property. 

 

She has called BOA repeatedly according to BOA.

 

BOA said that they have noticed this in a few files???

 

It seems that she may have gotten some e-mails intended for us.  There are a few times that BOA has insisted they sent us an e-mail but we did not get it.

That is disturbing. Whenever I call on behalf of my sellers BofA makes me go through all kinds of questions to make sure I am the same person who submitted the 3rd party authorization and that I know all the facts about the transaction, including buyers' names, etc. I don't know why they didn't check on Rhonda's authority before talking with her.
This Rhonda maybe an investor that is trying to buy the house and negotiate the short sale themselves.. Did you ask your seller to send email to Rhonda to stop calling BoA on their behalf and threatned to report them as committing fraud since they are not given authorization...
My initial thought was an investor as well. After corresponding back and forth it seems like she may not be. It appears that she might have other files with BOA and the negotiator sent her messages about my short sale...messages that I never received.

I am still trying to figure out how that could have even happened. If the negotiator had a couple of files on her desk and e-mailed the wrong one...still don't see how the notes on the file would reflect this person calling in on this property nor does it explain why BOA talked to someone that was not listed as having authorization on this file.
