Here is the situation:

The house was bought July 2007 for $191,000.  Since buying the house has been kept in good repair, there is no damage, no trash and is decorated/staged appropriately.  The seller paid $5,000 to add a half bath after closing.

February 2009 the house is listed at $195,000.  Through structured price reductions the house is reduced to $179,950 by December 2009 when we get a purchase offer of $179,950 paying $7195 in closing costs. 

The seller accepts and a COMPLETE file is sent to Bank of America on December 18, 2009.

Bank of American assigned it to the negotiator on January 11, 2010.

According to Bank of America the Negotiator (Betina Sparkling-Eddins) has 20 business days to respond to me in regard to this file. I have called daily and left her voice mails.  Her voice mail says that she will respond in 24 to 48 hours.  She has never called me.  I email her daily, her email response is always the following:

Hi, my name is Betina Sparkling-Eddins,

 

Thank you for your email. I currently have your file, it was assigned to me on
01/11/2010. I will be reviewing it
as soon as possible. I work all my files in the order received. I also pay
close attention to the ones that have an approaching FCL Sale Date.
These are at the top of my list and get worked first based off the date of
foreclosure.
 I will contact you
once I am able to review your
file.

Betina Sparkling-Eddins


My client received a notice this week, "Intent to accelerate". 

I have called customer support and they have escalated the file to Betina and her manager Brain Sweet with no response from either.  (left message for both on voice mail and customer support emailed him). 

What do I do?  Any help would be appreciated.

This is so typical. Does she/he have a fax number that they tell you in their recorded voice mail message? I once had a short sale that the only way I had to communicate with the person handling the file was to fax her a message. Voicemails and emails went unanswered. But as soon as I faxed her that message, the wheels started rolling! Bizarre. The only alternative you have is to wait, if they won't respond any other way. So far it seems that your file is on track.
I am on hold with them now I will ask for a fax number and see what I can do. Thanks.....no fax number....ugh.
Damon, My opinion is you are expecting too much too soon. BofA takes 4-6 months if you get lucky. Calling and leaving messages every day is going to get your file ignored. The best way I have found to get responded to is to use email. Place the property address and owner name in the subject line and the LN# in the body of the email. Be as sweet as sugar.

Be short and to the point. "Hope you are doing well. Any updates on this file? What can I do to assist you with getting this file approved and off your desk?"

The time frames you have mentioned do not sound out of line at all. Has a BPO been done?

Short sales will drive you crazy unless you exercise a lot of patience. Follow up no more than twice a week unless you have an emergency like stopping a foreclosure sale.

An Appraiser did a full appraisal on the property the end of September. BofA sent the appraiser out.
Damon, That appraisal would have been related to the foreclosure proceedings. Since the contract was submitted in December they will need to do a BPO. This is what I would ask them about when you call or email. See if you can get that expedited. The file will probably not get passed up to the next phase of negotiations without it. Do you know who the investor is? Fanniemae? FreddieMac?

Betina will probably never call you. She is really doing nothing more than making sure the file is complete including the stuff BofA is adding to it i.e. BPO(s), title work before passing it on.
It is a Freddie Mac loan......BofA inherited it from Taylor Bean and Whitaker.
Oh man. You have along ways to go if it's Freddie. They suck. I have some going on 9 months. Just stay on 'em. And pray :)
