Need help with a formerly approved short sale where Aurora had improperly filed a second lien that was discovered two days before closing, then they accidentally foreclosed, then we vacated the foreclosure, then they needed updated financials and new BPO and appraisal, then they had mediation, then they needed another BPO and NOW the approved price of last October is no longer acceptable and they want something in the range of $22,000 more.

IF they hadn't improperly filed their own lien (for a second mortgage that the Seller didn't disclose to his negotiating attorney), and then not stay the foreclosure like they said they were, we would have closed months ago. I am hitting a wall trying to get any Executive Office numbers or even anyone at the OCC. Any help would be greatly appreciated!!! Thanks, Sharon

Now they are telling me that the HAFA shortsale they approved will not include the $3000 relo assistance. WHAT!!!!!!!  How can they change the rules in mid stream.

My clients have waited 2 years, 3 offers and now they say, NO to giving them what is a hafa guideline....I know, guideline, not requirement.  BUT THIS JUST IS WRONG.

Who can I bring this complaint to that will create awareness of this system. Is NAR and CAR doing anyting with the monies we send them to lobby our governement!!!!!!!!

They have gotten a complete package every time. We were told workout package complete and sent to investor. Their own website says it is complete. I am at a loss for words.

You are right alisa instead of these same documents again it will be whole package again and they restart the click. Amazing

The "trick" to ALS is to fax over a complete package every time they ask for any document.  If they say they don't have it, mail it to them return receipt or fedex.

Ok.  I take back what I said aabout Aurora making progress.  A few weeks ago I was told Aurora had everything they needed and workout packages were sent on for 2 different offers on 2 different properties by same seller.  We would know by 2/17.  Now this is the second set of buyers- first walked b/c counter was higher than buyer would pay.  Get good offers which are exactly what counter was....so waiting for 2/17.

 

Seller gets a letter this evening in mail, dated 1/26, stating the following must be received within 10 days (which is actually today??).  It states:

 

Seller paraphrases (as Aurora never contacted me) letter states: They asked again for the most recent sign tax return an updated offer, Purchase agreement or sales contract (signed by all parties)  and 2 most recent bank statements and they sent another  form 1126 but did not ask for  new pay stubs.

 

I don't know what to say at this point.  I and seller spoke in-depth with the rep who sent the workout package on and she confirmed she got all this and we were good.  I go to myaurora and ironically for this property it shows all on track for 2/17 but on the other property that somehow it is now incomplete (although he has not received a notice).

 

I'm on my 3rd buyer for one and 2nd buyer for the other.  I am starting to believe Aurora doesn't want to do short sales, at all....

I probably will never take another Aurora short sale.  I have one that I listed this time last year!  Got a contract last April... unbelievably that same buyer has hung in there ALL OF THIS TIME, and we are finally going to close next week.  This company is totally out of touch and nowhere close to competent in handling short sales.  The individual people I have talked to and dealt with are all nice and seemingly hard workers, but to get to them, and to get the file off the ground and to stop their never ending baseless denials, or missing this, or form filled out wrong , or "we don't know why you're not assigned someone yet," or just the complete lack of ability to read notes in their own system is just baffling.  But we're almost done, and I'll be done with Aurora.

I posted on this site last October, and am still waiting for some kind of decision from Aurora.  It's been 7 months since paperwork submitted.  Back on October 26 they demanded rush BPO, so we got it set up for October 27.  It was done, and we did not hear anything again until December 12 when they requested the SPDS.  That was done and we haven't heard anything since.  We are still paying her rent, and she is still current and making house payments. Her agent keeps telling me that she has a hardship since her husband died, and he says it will definitely be approved for short sale.  I'm not so convinced.  Has anyone ever seen one be approved in this scenario?

UPDATE:  I finally got an Aurora rep to call me. She said she was confused by something on the authorization letters but seller explained it to her.  It didn't make much sense b/c on the last offer I had another rep pick up the phone and speak with me...and it was the same form.  BUT....she did call me and was very pleasant. I put my frustration aside, as all I really need is communication. 

 

Yes, Aurora restarts the clock at anytime.  In my situation I had a counter on 2 properties buyer wouldn't go up to.  A month later I got 2 full price offers.  I had to send in new packages with new offers - everything is rechecked (took approx 10 days).  From that date I was told they will have a response in 30 days (note BPOs were already done).

 

My previous offers were interesting.  The agent who called to tell me the counter on the 1 told me the 2nd was too low based on BPO and offer would be countered....but someone else would be calling me.  A week later I get a call from an agent who tells me they did the BPO on the other one, have the package and no offer to review though.  Mind boggling.  I tell the agent that's impossible b/c the other rep who sent package on had specifically requested a few sheets from the offer that somehow didn't come through on the fax (on a 50 page fax 5 pages somehow didn't come through that weren't next to each other....anyway....).  I got confirmation from the other agent they had been received and she forwarded the package on b/c it was complete with the offer.  So yes, I thought delay tactic also. I know they had the offer- they confirmed it to me (and discussed with seller) and a month later I was told by someone else they didn't have it.  Fortunately, I already knew it was too low for the BPO or I would have been very unhappy.

Another thing is don't rely on the website for upcoming trustee sale dates.  Agent said they are switching attorneys in some states and the dates are not accurate.

She also said they had recently made changes to their phone system and in future would be able to contact her directly.

Hey Superstars,

Per the below email Chain Aurora can restart the clock anytime they feel like it and do NOT factor in how long they've had your file.....Smells fishy to me especially since they get paid more to service deliquent loans....any good escalation contacts anyone can send me to my private email?

You last statement is correct. If the underwriter reviews that application and determines that the package is not complete, The process does restart once the requested documents are received.

Chris said it had to be complete to submit it the first time on 12/10….He wouldn’t have submitted a file to underwriting on 12/10 if it wasn’t complete.

 

I’m not trying to rock the boat but we have a legitimate argument here that deserves escalation.

 

I have confirmation from Chris that the file was submitted on 12/10 and was complete.

 

If I rely on your argument the clock would restart whenever underwriting says they’re needed updated or missing documents. 

 

Please advise.

Thank you for your prompt reply.

 

The complete application was submitted to underwriting by Chris on Dec 10th and during a weekly follow up call I discovered underwriting had kicked it out in January.  They kicked it out requesting additional documents that I provided the next business day.


We deserve credit for that additional 30 days 12/10/11 to 1/10/12. 

 

In addition to that 30 day period we had another 30 day hold up related to the 4056-t form have a box incorrectly checked .

 

I’m hopeful based on this information you can escalate the file.
