I have not taken a TCF file in the past 3 years due to their unprofessional ways of doing business, especially regarding the short sale process. Recently however, a friend of mine asked us to list and sell her home as a short sale- Her only loan is with TCF... I was hoping during these last 3 years that things have changed in their short sale processing but they are exactly how they were back in '09!
My clients are going through a divorce- The wife lost her job and has moved out of the home to live w/ her sister- Her spouse is in the home but is very cooperative and wants to sell so he can move on. Neither can afford the home as it is too expensive to maintain with only one income- Currently, it is underwater by about $100K...As their realtor, I was proactive and called TCF to get the SS packet- Everything is filled out, house is listed and we are pricing it aggressively to attract a buyer... In the meantime, TCF Bank has been strong-arming (I am being polite here) both of my clients to keep the home and to make payments- They are bad mouthing not only me, their realtor, but they are bad-mouthing their own short sale dept which said they do not want to hear from us again until there is an offer on the table. I tried talking to the VP of the local short sale dept and it is like talking to a rude collection agent- Why does the TCF short sale department call us their enemies? The guy told me he "despises" realtors!!! My clients have no other choice but to file BK in the event this VP blocks the short sale like he said he is going to do.... This is an epidemic I continually hear from fellow agents regarding TCF Bank- As a side note, I really think they are violating the Fair Debt Collections Act although an attorney pointed out that the Act only applies to 3rd party collections-? The last short sale I was involved with for TCF ultimately closed but in the very end of negotiations, TCF only allowed a 2% total commission for the agents to spit- Hardly enough to compensate for all the time we put in selling their non-performing asset... I usually do not take on TCF files for the reasons I mentioned above but I am willing to finish out this file if I can locate a TCF higher-up who is willing to approve a short sale- My clients are willing to make a contribution as they have not paid their mortgage for 3 months, however, TCF is in the process of speeding up the foreclosure time-line just to "screw" with the sellers as the VP said he was going to do-

TCF is tough to work with but if you put enough legal pressure on them, you can get a short sale approved....

Do you want to stay or move? You can refi with certain loan programs depending on your situation, if you rather stay. You can rent, or you can short sale. Do you know what type of loan you have? I would guess that it is a portfolio loan held by TCF.
