I've got a situation with Seterus.  

I am working a short sale with Seterus.  The seller lives out of state, but the house is in Georgia.  At the time of the purchase, the seller and her husband planned to relocate to the Atlanta area.  The file was forwarded to Fannie and came back with a request that my client make a 27k contribution.  My client has the money which came by way of her portion of some lottery winnings that she'd split with some other people.  The lottery proceeds equal about this amount.

When I listed the house, I purposely listed it slightly above market and we received and submitted a cash offer that's above list price, so there's no issue with the appraisal or the BPO done by Seterus.  My client has indicated to me that she's willing to make a contribution of 5k and that's it.  The seller's position is that she bought the house at the top of the market, put down 70k, has been paying mortgage for 6-7 years, etc.  The seller is requesting the short sale due to the fact that she and her husband have split up.

Seterus is looking at the property as an investment as you might've guessed.  How would you handle this situation if it were you? Thanks a million folks.

just send Seterus a counter offer with a revised HUD.

UPDATE - The lender has responded.  The file was approved with a seller contribution of $5,652.00 which the seller has agreed to pay.  Problem solved!

Your Client's "position" that She bought at the top of the market, lost her $70k down payment, and paid her interest due for 6 of the 30 years due, and her marriage didn't work out, means what....that the bank should pick up her loss for her? Does she also have any bad stock investments that Seterus should pay for? They are letting her walk away from how much debt?
