Does anyone invoice the seller the fee to withdraw a listing?

I have a client who has changed her mind to sell her property and instead wants to rent it. The fee the MLS charges to withdraw is $25. I have heard other agents say they have passed the fee along to the seller. Has anyone else had experience with this or have a form that use to do so? This is not the first time this has happened so the $25 fees can add up not to mention I am already at a lost for the time invested. FYI: I know some may say well why don't you list the rental, let's just say I am electing not to put anymore time and effort into this particular client.

I never charge a cancellation fee but my MLS does not charge to withdraw. can you just change the expiration date and let it expire tomorrow instead of withdraw?

Well I suppose I could but the listing agreement doesn't expire until Nov 2013.

Do a listing modification and expire the listing early.  Dont withdraw it, expire it

I would charge the fee if your MLS charges it. I would put it in the listing agreement.  How unusual.

Wendy what if the listing agreement has been previously executed? So now after the fact can I invoice? Ill have the fee paid directly to my brokerage hence the fee is charged to my brokerage who then transfers the cost to me.

Tarshema, If it's not in your listing agreement, I doubt the seller will pay it. I suppose you could ask them, and tell them you will be charged. The truth is you've probably spent a lot more than this fee in terms of time, etc. Just start adding that into your listing agreements or build that into your future business expenses. I have never heard of an MLS penalizing for withdrawing a listing.

I concur.  Build the relationship as well.  You never know when their circumstances may change.
